By accessing this website or engaging PragmaByte services, you agree to these Terms of Service.
If you do not agree with these terms, please do not use the website or continue a service engagement.
PragmaByte provides digital services including web design, development, system implementation, consulting, and maintenance support.
Detailed scope, deliverables, pricing, and timeline are defined in proposals, quotations, or written agreements for each project.
Project fees, payment schedules, and billing terms are agreed in writing before work begins.
Unless otherwise stated, invoices are due on the date indicated in the invoice. Delayed payments may affect project schedules, support response times, or delivery timelines.
Clients are responsible for providing timely feedback, required assets, accurate content, legal usage rights, and approvals necessary for project progress.
PragmaByte is not responsible for delays caused by missing materials, late approvals, or third-party access limitations outside our control.
Unless otherwise agreed in writing, pre-existing tools, code libraries, utilities, templates, and internal frameworks remain the property of PragmaByte.
Upon full payment for the agreed scope, clients receive rights to final deliverables specifically built for their project, subject to third-party licenses and platform terms.
Projects may use third-party services such as hosting providers, APIs, payment gateways, analytics tools, and plugin ecosystems.
PragmaByte is not liable for outages, policy changes, pricing changes, or discontinuation from third-party providers.
Services are provided on an as-is and as-available basis. We aim for high quality and reliability but do not guarantee uninterrupted operation or error-free outcomes in all environments.
Any specific support windows, maintenance coverage, or uptime commitments must be explicitly included in a written agreement.
To the maximum extent permitted by law, PragmaByte is not liable for indirect, incidental, special, or consequential damages, including lost profits, lost data, or business interruption.
Total liability for any claim related to services is limited to the amount paid by the client for the specific service giving rise to the claim, unless otherwise required by law.
Either party may pause or terminate a project engagement based on written notice and the terms of the active agreement.
On termination, completed work and outstanding balances are handled according to agreed milestone and billing terms.
We may revise these Terms of Service to reflect legal, business, or operational changes.
Updated terms will be posted on this page with a revised last-updated date.
These terms are governed by applicable laws of the Philippines, unless a signed agreement states otherwise.
